Environmental Justice (EJ) is one of the most important environmental issues in the U.S. today and impacts a wide range of commercial activities across many industries. Companies should now consider an EJ risk assessment as part of mergers, acquisitions, asset purchases, construction and expansion projects. EJ is becoming an important part of permitting, as well as environmental analysis under the National Environmental Policy Act (NEPA) and state analogues. EPA and other agencies are scrutinizing the permitting and regulatory compliance of warehouses, refineries, factories, chemical plants, and agricultural facilities in EJ communities. And environmental litigation of all kinds is increasingly including EJ claims. EJ is now an important facet of ESG, including SEC enforcement, shareholder actions and “greenwashing” claims.
