Global Construction and Infrastructure Disputes

Our Global Construction and Infrastructure Disputes team works with some of the world’s largest owners, developers, contractors, consultants, and financial institutions and investors to resolve complex construction disputes—frequently bet-the-company matters—in ways that support their business goals. Our attorneys have in-depth experience in the construction and engineering industries, with decades of experience in the disciplines of engineering, construction management, scheduling and delay analysis, and construction cost accounting. We have top-ranked construction lawyers throughout our worldwide network of offices, giving King & Spalding one of the broadest and deepest benches of construction and engineering lawyers in the world.

We represent clients in significant disputes arising from the construction of megaprojects, including hyperscale data centers, semiconductor manufacturing facilities, critical transportation and water management infrastructure, and cutting-edge biomedical facilities. Energy is another of our fortes. We focus on disputes arising from upstream, midstream and downstream energy-related projects, including refineries, petrochemical facilities, gas plants, LNG, GTL, pipelines, offshore production facilities, all types of power plants and other types of infrastructure projects.

King & Spalding brings industry and legal experience, resourcefulness, tenacity and commitment to ensure legal and commercial success in construction dispute resolution. We represent clients in construction-related disputes over amounts ranging from millions of dollars to over $10 billion, and litigate and arbitrate disputes concerning projects across the globe.

We often work as “Project Counsel” with clients during construction to manage issues as they arise, ensuring that our clients’ interests are fully protected and that they are in the best position possible to amicably resolve issues. Yet, when a formal dispute is unavoidable, we are at home in every type of dispute resolution forum—state and federal court, domestic and international arbitration, and in-project dispute resolution boards.

We have experience in the full gamut of construction-related claims including:

  • delays and cost overruns;
  • disruption and productivity impacts;
  • casualty events and industrial accidents;
  • engineering defects;
  • noncompliance with specifications, warranties, and performance guarantees;
  • HSE issues;
  • regulatory and compliance matters; and
  • state interference and expropriation issues.
