Dan Hettich focuses his career on assisting hospitals and health systems across the country with complex, multimillion-dollar Medicare and Medicaid reimbursement issues. A partner in our Healthcare practice, Dan advocates his clients' interests before the Centers for Medicare & Medicaid Services, Congress and federal courts, and assists his clients in dealing with fraud and abuse concerns.
Dan has a truly national practice and regularly counsels his clients on various aspects of Medicare reimbursement and related issues.
In the past few years alone, Dan has won final, favorable decisions overturning national CMS policy governing the reimbursement of Medicare bad debts, as well as agency denials of new residency program status (worth tens of millions of dollars to both of the hospitals); provider-based status (also worth many millions of dollars to the hospital); critical access hospital status; and volume decrease adjustments. In addition, he recently settled a False Claims Act case for about one-tenth of the alleged treble damages amount, in an issue of first impression in which the Department of Justice's underlying cause of action stemmed from the hospital's reporting of wage data affecting its wage-index.
Dan has been the Vice Chair of the American Health Lawyers Association's Regulation, Accreditation and Payment practice group since 2013. He is also a frequent speaker at the AHLA's annual Institute on Medicare and Medicaid Payment, as well as a speaker and presenter for the AHLA's Annual Meeting, the American Bar Association Health Law Summit, and RACMonitor.
Dan was nominated to become a Fellow of the American Bar Foundation in 2017; was recognized as one of the top litigators under 40 by Benchmark Litigation in 2016; and was named a Rising Star by Law360 in both 2015 and 2016.
