What’s Left of Off-Campus Provider Based and CMS’s Other 2017 OPPS and MPFS Proposals

This Roundtable will discuss the major provisions of CMS’s CY 2017 Outpatient PPS and Physician Fee Schedule Proposed Rules. The OPPS Proposed Rule includes CMS’s attempt to implement Section 603 of the Bipartisan Budget Act of 2015, which directs CMS to pay for most items and services furnished in new off-campus provider-based departments at the applicable non-facility payment rate. CMS’s proposals present significant legal, financial and operational challenges to all hospitals that operate off-campus provider-based departments. On Thursday, July 21, 2016, King & Spalding is hosting a 75-minute Roundtable which will analyze the essential items contained in CMS’s discussion of Section 603, as well as possible solutions to many of the challenges CMS has created:

  • What provider-based departments are subject to Section 603? What departments are exempt? What services are affected?
  • How does CMS propose to pay for services furnished in a new off-campus provider-based department?
  • To what extent may a hospital relocate or otherwise alter an off-campus department excepted from Section 603’s payment changes?
  • How might CMS’s proposals affect qualification under the 340B Drug Pricing Program, Medicare bad debt and other payment issues?
  • What are the prospects that CMS actually adopts its proposals, and is there any possibility for Congressional intervention?

The Roundtable will also discuss other provisions included in the OPPS and PFS Proposed Rules including:

  • Changes to the Medicare EHR Incentive Program;
  • Updates to hospital quality reporting;
  • Proposed changes to the federal Stark Law regulations;
  • Additional funding for certain preventative and care coordination activities; and
  • Mandatory enrollment in Original Medicare for providers and suppliers to contract with Medicare Advantage plans.
