The integration of rooftop photovoltaic systems into the real estate portfolios of investment funds is politically desired and economically sensible but has so far been associated with regulatory and tax-related uncertainties. In particular, the prohibition of operational activities by funds, as well as investment tax restrictions, have hindered practical implementation and often forced the real estate fund industry to refrain from planned projects or to resort to less profitable models - such as leasing roof space to external photovoltaic system operators.
With the Location Promotion Act, lawmakers are now sending a clear signal: key regulatory and tax obstacles are being removed. This opens up new, more practical opportunities for real estate funds to install and operate rooftop photovoltaic systems on fund properties themselves.
