Emerging Trends Regarding EPA’s Regulations Affecting Products: What Life Sciences Companies Should Know


On September 3, 2021, EPA issued an interim final rule regarding the import and distribution of consumer and commercial goods containing certain persistent, bioaccumulative and toxic (PBT) substances. Life sciences industry advocates had voiced concerns about the impact of these rules on some components of medical equipment, particularly semiconductors, and on the equipment used by manufacturers of pharmaceutical and medical devices. EPA is also issuing rules phasing down production and consumption of hydrofluorocarbons (HFCs) by 85 percent over the next 15 years, which directly impacts metered dose inhalers. Finally, EPA is issuing a reporting rule to collect information about manufactured and imported goods containing per- or polyfluoroalkyl substance (PFAS), a family of chemicals in a large swath of manufactured products.
