Environmental, social and governance (“ESG”) issues are playing an increasingly significant role in investment making by companies and in Government policy-making.  As a result, ESG issues are also increasingly featuring in disputes, in particular international arbitration, both commercial between private parties and against host States under investment treaties.  

Our speakers from King & Spalding’s International Arbitration practice will discuss practical examples of ESG-related disputes and means for companies to mitigate the risk of such disputes, including: 

  • Environmental: disputes arising out of renewable energy projects, decommissioning of oil and gas assets; host States’ changes to their legislative framework (eg revoking subsidies for renewable energy investments; banning some types of energy or mining projects);
  • Social: the role of human rights in commercial disputes;
  • Governance: bribery / corruption allegations.
