When Worlds Collide: Balancing the Responsibilities of the MEC and HR in Physician Peer Review

On December 16, we will be hosting an Atlanta-based Roundtable to discuss some of the personnel issues raised when hospitals and other healthcare entities shift away from the traditional model of an independent medical staff towards a physician-employee model. As hospitals have consolidated over the last decade, more and more are employing physicians directly to serve on the hospital staff in their efforts to capture admissions and shore up a referral base. This trend raises potentially thorny issues with regards to the interaction between the hospital’s human resource (“HR”) department and its medical staff, which is generally under the purview of the hospital’s Medical Executive Committee (“MEC”).

Federal and state laws convey a significant number of rights to employees that have not generally been applicable to an independent medical staff. Thus, many facilities are unprepared when these laws apply to their newly employed physician workforce. Further, facilities that do not intend to employ physicians may find that the policies and procedures they have developed, particularly those relating to quality assurance, essentially convert their medical staff into employees. Additionally, the need to deal with aging or disruptive physicians can potentially become more complicated when these individuals are afforded the rights applicable to employees under state and federal laws.

This Roundtable will be of particular interest to hospitals and other healthcare entities that do or may employ physicians and must deal with the changing rights and responsibilities that result from the shift away from an independent medical staff.
