This program will highlight certain significant risks faced by companies operating in the life sciences industry, and will address ways that companies can maximize their insurance recovery in the event of claims.  The program first will focus on the unique data and privacy risks to life sciences companies such as medical device manufacturers, pharmaceutical companies, and biotech companies, and will highlight issues that life sciences companies should consider when purchasing cyber insurance and pursuing coverage for data breach or privacy breach claims.  Second, the program will discuss emerging D&O and E&O coverage issues in the life sciences industry, and will discuss how those coverages can reduce a company’s exposure to expensive False Claims Act liabilities.  Third, the program will discuss the promise and pitfalls of attempting to manage life sciences product liability risks through indemnity agreements and “additional insured” provisions, which must be carefully negotiated to avoid inadvertently giving away valuable insurance coverage. The panel will also provide practical advice to maximize insurance recoveries in the event of claims.
