Across the country, the healthcare industry is constructing new hospitals, clinics, offices, and other facilities. If the owner is not careful, costs for these projects can spiral out of control and the project can be delayed for years. This program will address common issues in construction contracts, where owners face exposure, and how to mitigate the potential problems. We will present hypothetical examples to illustrate practical approaches to identify and navigate different types of risks related to healthcare construction projects. Our discussion will include the following:
- The differences between the various contractual dispute resolution procedures and forums, and which ones are most advantageous to owners.
- Schedule and delay issues, including liquidated damages, bonuses, and force majeure.
- Change order management, including unilateral change orders, unsigned change orders, and retainage.
