On September 25, 2025, the parties filed a Stipulation of Dismissal in the United States District Court for the District of Colombia to dismiss with prejudice claims filed by an anonymous accounting firm (identified as John Doe Corp.) challenging the constitutionality of the PCAOB’s in-house disciplinary process. According to the Stipulation of Dismissal, the PCAOB accepted an offer of settlement from John Doe Corp. on September 23, 2025, and “[t]he parties previously agreed that, ‘[i]f approved, the settlement would moot Doe Corp.’s claims.” The MarcumBP settled disciplinary order discussed above was approved by the PCAOB on September 23, 2025, and was the only one announced this week.
The Stipulation of Dismissal states that the dismissal of John Doe Corp.’s claims will not have an effect on other consolidated actions challenging the PCAOB’s disciplinary process.
