Consumer Products Litigation

With both the plaintiffs’ bar and State Attorneys General placing increased scrutiny on false advertising claims, public health and product safety and contamination issues, consumer product companies frequently turn to our Consumer Products Litigation team to fend off such claims. With a “consumer products litigation team . . . reputed for the range and complexity of its product liability and class action matters” (Legal 500), our team defends manufacturers, distributors, and sellers of consumer goods in litigation alleging both physical and economic harms.

Packaged goods, personal care and cosmetics, technology, food and beverage, and retail companies turn to us for representation in individual actions, MDL and coordinated proceedings, and class actions involving product liability, false advertising/consumer fraud, unfair competition, and consumer protection statutes including the TCPA, FCRA, and California’s Proposition 65. We also represent companies before the Consumer Product Safety Commission (CPSC).

Our long history of representing companies facing allegations of harms caused by their products or services, whether it is social media, baby food, pharmaceutical and personal care products, tobacco, video games and in-vehicle driver assistance technology, among many others, has made us well-versed with plaintiffs’ lawyers’ efforts to exploit the public and juries’ emotions regarding “corporate America,” particularly in connection with top selling household products.

We have significant experience squaring off against plaintiffs’ counsel that rely on dubious, litigation-driven science to allege that products contain impurities that cause adverse health effects. With a dedicated team of attorneys with advanced science degrees, as well as scientific specialists with degrees in epidemiology, biostatistics, toxicology, among others, we have a track record of uncovering critical flaws and biases in scientific studies and limiting or excluding related expert opinions, developments which are often case-dispositive.

With an unrivaled bench of first-chair trial lawyers, we have tried nearly 100 cases involving consumer products to verdict since 2015, seizing every winning opportunity for our clients, whether the goal is a defense verdict at trial or favorable settlement. Regardless of the ultimate end-game strategy for a particular case, presenting a credible trial threat and having “first chair confidence” helps us defend our clients’ interests effectively and often enables us to bring cases to early favorable resolution.
