King & Spalding Secures Significant Summary Judgment Victory for Boehringer Ingelheim in Zantac-Related Litigation


King & Spalding secured a significant summary judgment victory for Boehringer Ingelheim (Boehringer) in a Zantac-related case in the Eighth Judicial District Court in Clark County, Nevada. On June 7, 2026, the court granted Boehringer’s motion for summary judgment, holding that plaintiffs could not prove causation without admissible expert testimony after the court excluded their general and specific causation experts.

The ruling followed the court’s order denying plaintiffs’ motion for reconsideration of an earlier order excluding plaintiffs’ causation experts, reaffirming that plaintiffs lacked admissible evidence that Zantac can cause esophageal cancer or that it caused the plaintiff’s alleged injury. With no viable causation evidence, the court concluded that plaintiffs could not establish a necessary element of their claims, resulting in complete judgment in Boehringer’s favor. 

King & Spalding has been serving as Boehringer’s national counsel for all federal and state claims in litigation over allegations that the antacid Zantac is associated with an increased risk of cancer.
