Company leaders don't think much about it until it happens to them. But at some point, most companies must confront allegations of misconduct directed at senior leadership or even the C-suite. These are no ordinary investigations, and special precautions must be taken by in-house counsel to protect both the interests of the company and the counsel's own interests.
In this seminar, we will explore some of the unique issues that must be considered in these investigations, including:
- the challenges of structuring an investigation;
- what “independence” means in an independent internal investigation;
- the challenges of evidence collection, including protecting privilege and avoiding widespread rumormongering; and
- practical realities every in-house counsel must face, including:
- managing the obstructionist target;
- determining who has real "skin in the game";
- managing stakeholder requests for real-time updates;
- delivering the "unpopular" recommendation; and
- protecting their own reputation within the company.
