King & Spalding Secures Defense Victory for ScribeAmerica in False Claims Act Case


In May 2024, a False Claims Act complaint was unsealed in the Central District of California against King & Spalding client ScribeAmerica, Envision Healthcare, and KKR. The relators alleged that the defendants had coordinated on a scheme to defraud government healthcare programs by falsifying records. These allegations were false. The complaint asserted 38 claims and sought damages and penalties of more than $3 trillion.

All three defendants filed motions to dismiss. Two of the lead arguments were that the “first-to-file bar” and “public disclosure bar” precluded relators’ claims. We argued that earlier, unsuccessful cases had previously alleged the same types of fraud alleged here, and thus under the False Claims Act, this case was barred and should be dismissed. On November 19th, 2025, the Honorable Cynthia Valenzuela of the United States District Court for the Central District of California issued an order granting our motions to dismiss with prejudice.
