• Represented BASF, a multinational chemical company, in the U.S. Court of Appeals for the Federal Circuit, defeating patent infringement claims and successfully defending a nearly $100 million antitrust judgment.
• Represented Boehringer Ingelheim in the Delaware Supreme Court, reversing the erroneous admission of critical expert testimony in one of the largest mass tort actions in state history.
• Represented DIRECTV in the U.S. Court of Appeals for Second Circuit, reviving the company's antitrust price-fixing claims against the largest local television broadcasting conglomerate in the United States.
• Represented The Gap in the U.S. Court of Appeals for the Second Circuit, defeating a securities class action alleging that the company's risk disclosures and other statements were materially misleading.
• Representing Amgen in federal litigation challenging Colorado's scheme of price regulation for patented drugs, including obtaining a preliminary injunction.
• Represented Progressive Casualty Insurance and affiliates in the U.S. Courts of Appeals for the Third, Fourth, Seventh, and Ninth Circuits, defeating class certification in cases challenging Progressive's methodology for valuing totaled vehicles.
• Represented Emory University in the U.S. Court of Appeals for the Eleventh Circuit, reversing certification of class seeking tuition refunds for use of remote learning during COVID.
• Represented the American Clinical Laboratory Association in successful challenge to FDA rule that would have regulated laboratory testing services as medical devices.
• Representing KKR & Co, Inc., a leading global investment firm, in the Kentucky Supreme Court in litigation concerning state pension funds.
• Represented Terumo, a global medical technology company, in the Colorado Court of Appeals, defeating a medical monitoring class action and securing a precedential ruling that medical monitoring claims require physical injury.
• Represented Google in the U.S. Court of Appeals for the Federal Circuit, defeating patent infringement claims based on ineligible subject matter.
• Represented Heartland Payment Systems in the U.S. Court of Appeals for the Third Circuit, defeating merchant class action challenging payment processing fees.
• Represented The Sea Island Company in the Georgia Court of Appeals, securing dismissal of litigation disputing ownership of causeway and roads on Sea Island.
• Represented a fintech company in the U.S. Court of Appeals for the Eleventh Circuit, obtaining reversal of damages award in trade secrets litigation.
• Represented a radiology practice in the U.S. Court of Appeals for the Eleventh Circuit, overturning an adverse jury verdict under the False Claims Act.
• Represented a South Carolina death row inmate in the U.S. Court of Appeals for the Fourth Circuit, securing reversal of death sentence.

Paul represents clients in a variety of matters, including those involving antitrust, constitutional litigation, class actions, intellectual property, and medical drugs and devices.

Paul has argued more than two dozen appeals across numerous federal and state appellate courts, including the U.S. Courts of Appeals for the Second, Fourth, Seventh, Tenth, Eleventh, D.C. and Federal Circuits and the Supreme Courts of Delaware and Kentucky.  He has also briefed and argued critical motions in many federal and state trial courts.

Paul is one of few attorneys in the country to have clerked for three U.S. Supreme Court Justices.
