Emily Marsteller

Emily's practice spans antitrust and consumer protection litigation, government investigations, merger review, and compliance counseling, giving her an integrated perspective on the competition and regulatory challenges facing companies today.

Emily has represented both plaintiffs and defendants in complex, multi-party antitrust disputes, including arbitration and class action litigation. She has taken a leading role in discovery, depositions, expert work, and trial preparation in matters spanning diverse industries. She also has defended companies in class actions alleging antitrust violations and other claims, with experience in motion to dismiss briefing, written and third-party discovery, and meet-and-confer negotiations. Emily has experience in all phases of litigation, from discovery and depositions of fact, 30(b)(6), and expert witnesses through trial preparation.

Emily's regulatory practice focuses on merger review and government investigations. She advises clients on the antitrust risks of proposed transactions, prepares HSR filings, and advocates for clients before the FTC and DOJ, including in responses to voluntary access letters and second requests. Emily also has significant experience guiding clients through criminal and civil subpoenas and civil investigative demands from start to finish, including negotiating response terms and search terms, identifying key documents, and supporting written and oral advocacy.

In her counseling practice, Emily advises clients on antitrust compliance and consumer protection regulations, including Section 5 of the FTC Act and the FTC's Mail, Internet, or Telephone Order Rule.

Emily maintains an active pro bono practice and has successfully represented a client in a custody proceeding in D.C. Superior Court.
