Douglass Cassel specializes in business and human rights, international human rights law, and international law. As scholar and practitioner, he publishes influential articles in each of these fields, teaches in leading law schools, counsels clients, conducts investigations and negotiations, and represents and defends clients before national and international courts and human rights bodies. He advises corporations and attorneys on developments in the field of business and human rights and ESG, assists in developing policies and practices on human rights due diligence and risk avoidance, and helps resolve claims of adverse impacts by claimants, shareholders and ESG rating agencies.
Professor Cassel is a widely recognized expert on business and human rights, international human rights law, and public international law. He has taught in these fields for decades, most recently at Notre Dame Law School, where he was a Notre Dame Presidential Fellow. He has also taught and lectured on these subjects at leading universities in Belgium, England, Hungary, Mexico and Spain. He has published more than one hundred scholarly articles and reviews.
Cassel has represented international law experts, retired United States diplomats, and other distinguished amici curiae in eight cases before the United States Supreme Court and advised in two others. Most recently, he represented amici former United States diplomats and international development practitioners, including Joseph Stiglitz, Nobel Prize-winning economist and former Senior Vice President and Chief Economist of the World Bank, in urging the Court to allow judicial review of loan activities by the International Finance Corporation.
Cassel has assisted human rights victims before the Inter-American Commission and Court of Human Rights, the European Court of Human Rights, and the International Criminal Court. In 2021 he secured precautionary measures from the Inter-American Commission on behalf of the owners of Nicavisión, S.A., who credited the measures for saving the last independent TV station with nationwide coverage in Nicaragua. He also represents both victims and companies before United Nations human rights bodies.
His articles have been published in the Business and Human Rights Journal, Business Ethics Quarterly, and many other scholarly journals. He authored the chapter on jurisdiction in Research Handbook on Human Rights and Business (Edward Elgar Pub. 2020). On behalf of the American Bar Association’s Human Rights Center and the Law Society of England and Wales, he was principal author of the White Paper: Options for a Treaty on Business and Human Rights (2015). He is a member of the editorial board of the ABA’s Key Business and Human Rights Documents.
Cassel has both defended and sued major corporations. Before the Inter-American Commission on Human Rights and various United Nations human rights rapporteurs, he defended Chevron from an attempt to enforce a fraudulent judgment entered against the company in Ecuador.
He is experienced in investigations, negotiations and diplomacy. He was Legal Advisor to the United Nations Truth Commission for El Salvador; investigated military massacres in Colombia and Thailand; and chaired an independent international panel investigating paramilitary killings in Northern Ireland. Colombia’s Nobel Laureate President Juan Manuel Santos called on him to help negotiate the transitional justice provisions of the peace treaty with FARC guerrillas. President Santos later awarded Cassel the highest honor given by Colombia to foreign civilians.
A former president of the Due Process of Law Foundation, Cassel was elected four times by the Organization of American States to serve on the Board of the Justice Studies Center of the Americas, of which he was president.
