Johnson & Johnson Wins Full Dismissal on the Eve of Trial

King & Spalding trial attorneys Alexander Calfo, Peter Strotz, Susan Vargas and Stacy Foster achieved a litigation win for client Johnson & Johnson in a lawsuit alleging plaintiff Joseph Lee developed mesothelioma due to exposure to Johnson’s Baby Powder.  The case was venued in Solano County, California before Judge D. Scott Daniels.

Plaintiffs demanded $10,000,000 to settle the case with Johnson & Johnson shortly before the January 24, 2019 trial.  On February 19, 2019 - and on the eve of hearings on the admissibility of plaintiffs’ experts’ testimony - plaintiffs agreed to an outright dismissal of Johnson & Johnson with prejudice for $0.  Plaintiffs further agreed to release all potential future claims, including wrongful death, from plaintiff Joseph Lee’s heirs.

This case victory is significant to Johnson & Johnson, who has been vigorously defending lawsuits alleging mesothelioma from Johnson & Johnson’s consumer product, Johnson’s Baby Powder.
