Ineffectiveness of “bad leaver clauses” in virtual employee participation schemes

Employee participation programs are a key instrument, particularly in private equity practice, for aligning the interests of shareholders (investors) with those of management and key employees. A new Federal Labor Court ruling on “bad leaver clauses” has implications for practice in Germany and is discussed in this article. This article is only available in German.
