  • Bruce is the only outside counsel who was part of the team that represented Google in the long-running copyright lawsuit with Oracle regarding the use of Java declaring code in the Android mobile device operating system. Bruce participated in both jury trials in the Northern District of California, both appeals to the Federal Circuit, and Google's successful cert petition and landmark Supreme Court fair use decision in 2021 -- which upheld the fair use defense that Bruce first argued in the district court in 2011.
  • Bruce is representing Perplexity AI in a copyright and trademark infringement action in the Southern District of New York, in which The New York Times and its affiliates accuse Perplexity of infringing millions of copyrights owned by the Times and infringing the THE NEW YORK TIMES, WIRECUTTER and THE ATHLETIC trademarks.
  • Bruce is primary copyright counsel for a group of individual defendants who were principals in NGINX, Inc., a software company that developed the widely-used NGINX web server software and was purchased by F5, Inc. in 2019, and are accused of copyright infringement by the assignee of their former Russian employer.
  • Bruce is serving as lead counsel for Crocs, Inc. and its subsidiary Jibbitz, Inc. in a trade dress and patent infringement action in the Southern District of New York against a China-based seller of shoes that infringe Crocs' and Jibbitz's IP rights.
  • Bruce has served as the primary copyright counsel for Dolby Laboratories Licensing Corporation and its affiliates in significant breach of contract and copyright infringement actions in the Northern District of California against Adobe, Inc. and Roku, Inc.
  • Bruce has represented The Coca-Cola Company in a wide variety of trademark, trade dress, copyright and other litigated intellectual property matters in federal courts across the country, including successful appeals in the Fifth, Sixth and Seventh Circuits.
Bio

Bruce Baber focuses his practice in intellectual property, with an emphasis on litigation and other contested matters. A founding member and senior partner in our Intellectual Property Litigation practice, Bruce works with a wide variety of clients in patent, copyright, trademark and trade dress infringement matters; false advertising disputes; significant IP transactions; and strategic global portfolio management issues.

Bruce represents global and national companies in copyright and trademark infringement; dilution and counterfeiting matters; and false advertising disputes. He represents clients before the U.S. district courts and courts of appeals nationwide, the U.S. International Trade Commission, the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office, and the National Advertising Division of the Council of Better Business Bureaus.

Bruce is experienced in advising companies on the protection of trademarks, copyrights and other forms of intellectual property; the prosecution of applications for registration of these properties; and the development and implementation of worldwide protection strategies and risk assessments relating to IP issues of all types, including potential false advertising claims. He has been involved in many high-profile litigation matters and numerous major licensing and other intellectual property-related corporate transactions, joint venture agreements and marketing agreements.
