  • Won an award for declaratory relief worth approximately US$ 9.5 billion and US$ 215 million in damages on behalf of Chevron Corporation against Ecuador in an UNCITRAL international arbitration under the U.S.-Ecuador Bilateral Investment Treaty. This case concerns the fraudulent Lago Agrio environmental judgment issued by the Ecuadorian courts, resulting in precedent-setting awards in favor of Chevron, including a finding of denial of justice and treaty breaches by Ecuador’s courts, as well as numerous interim measures awards ordering Ecuador to prevent enforcement of the court judgment.
  • Won a US$ 100 million award on behalf of a seller consortium of seven of the world’s largest energy companies against an Asian buyer in an LNG price review arbitration (Singapore-seat; UNCITRAL Rules; New York governing law) (2020).
  • Won an award for over US$ 2 billion in damages on behalf of a major Spanish energy company against Egypt under a bilateral investment treaty concerning the failure to supply natural gas in a long-term supply agreement.

  • Represented a consortium of three of the world’s largest energy companies in a consolidated LNG price review arbitration under two LNG SPAs with one of the world’s largest Asian buyers, with a price differential of approximately US$ 2 billion. The dispute settled successfully for our clients during the arbitration (Singapore-seat; LCIA Rules; English governing law) (2023).
  • Represented one of the world’s largest energy companies in a LNG price review arbitration with one of the world’s largest Asian buyers, with a price differential of hundreds of millions.   • Won a $360 million award for Burlington Resources in an ICSID arbitration against Ecuador, arising out of the expropriation of an oil concession and associated counterclaims for alleged environmental contamination.
  • Successfully represented major international oil company in UNCITRAL arbitration involving claims in excess of $1.5 billion against the Government of India. We obtained a full dismissal of counterclaims against our client.
  • Won a favorable award for declaratory relief in an ICC expert arbitration on behalf of Phillips 66 against PDVSA and one of its subsidiaries, arising out of the price protection mechanism in a long-term crude oil supply agreement for a Texas refinery.
  • Representing Shell in a multi-billion dollar ICSID arbitration against the Republic of the Philippines under the Netherlands-Philippines bilateral investment treaty concerning Shell's investment in the Malampaya gas-to-power project. We recently obtained provisional measures in favor of Shell.
  • Representing major LNG seller consortiums in LNG price review negotiations and arbitrations against large Asian buyers, with price differentials ranging from hundreds of millions to billions of U.S. dollars.
  • Representing Chevron Thailand Exploration & Production Co. in an ad hoc arbitration against Thailand, concerning decommissioning of offshore assets in the Gulf of Thailand.
  • Representing a major Philippine conglomerate in an SIAC arbitration against its Indonesian joint venture partner, arising out of a dispute over shares in a Dutch venture that owns and operates the major toll roads in and around Manila.
  • Representing an Indonesian pipeline operator in an HKIAC arbitration against a gas producer and a gas shipper, arising under an agreement for the transport of natural gas from an offshore Indonesian field.

Bio

Anisha Sud represents clients in high-stakes international commercial and investor-State arbitrations in the energy sector, including disputes involving long-term foreign investments, multi-party joint ventures, and government entities. Several of her arbitrations exceed USD 1 billion in dispute and are considered landmark cases. Based in Singapore for nearly a decade, she brings deep experience with APAC-nexus disputes across multiple industries.

Anisha handles international disputes across a variety of industries, including energy, infrastructure, tech, and pharma. In the energy sector, she has particular experience with disputes arising from LNG SPAs, MSAs, production sharing contracts, concession agreements, gas sale and transportation agreements, and BITs. Her areas of focus include LNG price reviews, force majeure, decommissioning, hydrocarbon contamination, subsurface reservoir characteristics, oil & gas infrastructure, and take-or-pay obligations. In Asia, she has handled more than a dozen high-stakes LNG price review negotiations and arbitrations in recent years, along with disputes arising from force majeure, failure to take/failure to deliver, and related claims.

She is fluent with the major arbitration rules, with repeated experience in arbitrations convened under the ICC, ICSID, LCIA, SIAC, and UNCITRAL Arbitration Rules. She works closely with technical experts on her matters and is well-versed in the technical and financial aspects of long-term investment projects and purchase and supply arrangements, in addition to their legal and contractual frameworks.
