James McCormick is counsel in King & Spalding’s Corporate, Finance and Investments practice. James advises clients at all stages of development, from emerging companies to well-established public companies, on commercial and technology transactions, including procurement, outsourcing, distribution, resale, marketing, sales representative, purchase and supply, and consulting and professional services transactions. James has worked with companies in a broad range of industries, including the software, hardware, cybersecurity, fintech and e-commerce sectors.

James’ commercial contracts and technology practices include the structuring and negotiation of software, content and other technology development, licensing and transfer agreements; product integration and distribution agreements; operating services agreements; terms of service and software-as-a-service agreements; maintenance, support and hosting agreements; electronic commerce transactions and privacy policies; and logistics agreements.

In recent years, James has advised several multinational enterprises on structuring complex outsourcing and procurement transactions affecting critical business processes. This work has included advising clients on the development of requests for proposals, analysis of bid responses, downselection of vendors, and negotiation of services and supply agreements with selected vendors.
