US Discovery in Support of German Proceedings
Under United States federal statute 28 U.S.C. § 1782, litigants involved in a foreign proceeding may apply to a United States District Court to order a person residing in that Court’s district to produce discovery for use in a foreign or international tribunal. When properly used, § 1782 can be a powerful tool for litigants in tribunals where such discovery is otherwise unavailable.
Using this tool is a strategic choice for German companies. It can be applied in proceedings with no US connection other than the likely presence of evidence in the States.
Litigation attorney Peter Sauer from Denver will cover the basics of taking discovery in the United States under § 1782, discuss the practical limits of such discovery requests, and provide an update on recent case law applying the statute. Dr. Sebastian Müller of our Frankfurt dispute resolution team will provide examples of German companies making use of this tool and how to deal with it as a claimant or respondent in German proceedings.
