Liability Proceedings Against Capital Investment Companies: Liability Risks, Prevention and Lessons Learned
It’s a well-known game: If an investment is successful, liability issues play a minor role. When losses occur in the course of the investment, however, investors often seek to recover all or parts of their invested capital through legal action. Whereas, in the past, such “retroactive complaints” –German courts use the term “Investitionsreue”–, primarily occurred in the consumer-business, we see nowadays a similar trend in the institutional sector.
The possible liability scenarios have become more complex since the coming into force of the German Capital Investment Act. In practice, it has become a considerable challenge to distinguish the responsibilities—and thus also a possible liability—of the parties involved. Based on our own disputes experience, this seminar will address possible liability risks and discuss potential ways of prevention.
