Rounding Out 2020: Overview of Recent Statutory and Regulatory Changes to Medicare and Medicaid Reimbursement

There were several developments of note for Medicare and Medicaid reimbursement in the waning days of 2020. On December 2, 2020, CMS issued the final rules for the Outpatient Prospective Payment System (OPPS) and the Medicare Physician Fee Schedule (PFS). And later that month, Congress passed and the President signed the Consolidated Appropriations Act of 2021, which includes numerous changes to Medicare and Medicaid reimbursement, such as revisions to Medicare graduate medical education (GME) payments and Medicaid disproportionate share hospital (DSH) payments.   

King & Spalding is hosting a 90-minute roundtable webinar on January 19, 2021, to discuss the changes to Medicare and Medicaid reimbursement that came in the final month of 2020. Topics for discussion will include:

  • The final rules for the CY 2020 OPPS and the PFS, including Congress’s partial repeal of the budget neutrality adjustment for the PFS;
  • Statutory changes to Medicare GME payments, including the distribution of additional residency positions and a second chance for some hospitals to build new FTE caps and per-resident amounts;
  • Statutory changes to Medicare payment for rural providers, including a new payment provision for rural emergency hospital services and enhanced payments for rural health clinics; and
  • Statutory changes to Medicaid DSH payments, including the elimination of the DSH allotment reductions for 2021 through 2023 and the modified DSH cap.
