In the last decade, the Supreme Court has revolutionized the law of personal jurisdiction as it applies to corporations. By making clear that a corporation is subject to general jurisdiction only where it is incorporated or has its principal place of business, the Court revived a long dormant issue: the limits of specific personal jurisdiction over a corporation that sells goods or services in multiple jurisdictions. These limits have created an important new restriction on plaintiffs’ ability to forum shop, especially in product liability cases involving single-use items like pharmaceutical products and medical devices. This presentation will outline the recent case law and upcoming challenges concerning personal jurisdiction over foreign corporations, and discuss the practical implications and opportunities for corporations challenging a state’s exercise of jurisdiction over nonresident defendants.
