No Surprises Act Update: The IDR Process Final Rules and the Impact on Managed Care


On August 19, 2022, the Departments of Health & Human Services, Labor, and the Treasury issued the long-awaited Final Rule on the Independent Dispute Resolution (IDR) process under the No Surprises Act. Separately, the Departments also issued lengthy Frequently Asked Questions and technical guidance for IDR entities.

King & Spalding will host a one-hour roundtable webinar on September 22, 2022 to discuss the new rule and guidance and their implications. Topics for discussion will include:

  • The impact of the new Final Rule on the IDR process
  • Lessons learned from the first 5 months of the IDR process
  • Prior challenges to the Interim Final Rule addressing the IDR process and potential future challenges to the Final Rule
  • The impact of the No Surprises Act on the managed care landscape
