Navigating the Future: Considerations Related to “Femtech” and Other Digital Health Tools


The world of digital health is expanding at an exponential rate, and one key area is that of software applications that are directed at women, aka femtech.

Questions abound in this novel area, from FDA regulatory issues, state law issues, and Anti-Kickback Statute issues to privacy issues and questions unique to femtech apps that are intended to be used with prescription drugs.

King & Spalding hosted a one-hour roundtable webinar on February 24, 2022, to discuss this rapidly evolving area and implications for femtech developers. Topics for discussion included:

  • Threshold regulatory questions to ask when launching a femtech start-up;

  • FDA and state law regulation of digital health tools, including femtech;

  • Gray areas, areas of risk to watch out for and potential risk mitigation strategies; and

  • Use of femtech software in health-related communications and communications related to prescription drug use.
