Since capturing the world’s attention in 2017, the “#metoo” movement has prompted a surge in allegations of workplace sexual misconduct, including in the healthcare industry. Meanwhile, a growing number of cities and states have enacted laws intended to address workplace sexual misconduct, including laws pertaining to covered policies and training, laws limiting the use of confidentiality and mandatory arbitration provisions in settlement agreements pertaining to sexual misconduct, and laws extending statutes of limitations relating to claims of sexual misconduct.
In this environment, businesses are grappling with how to prevent and respond to allegations of sexual misconduct. Healthcare systems are facing high-profile allegations of sexual misconduct by physicians and other staff that put their licenses and accreditations at risk, not to mention threaten the sanctity of the provider-patient relationship.
