Making the Most of Appellate Counsel at Trial

As the number of civil jury trials continues to decline, the lawyers who try high-risk cases are growing increasingly sophisticated. Experienced trial counsel deploy legal issues counsel as a key team member.  While the legal issues role has traditionally focused on positioning the case for appeal, effective legal issues counsel can work closely with trial counsel to improve the chances of success at trial.

Two experienced legal issues counsel (Val Leppert and Scott Edson) and two trial lawyers (Ursula Henninger and Katy Lehman) will speak from their differing perspectives (gained from collectively trying more than 60 cases) on how legal issues counsel can best integrate into a trial team. The panel will discuss how integrating seasoned legal issues counsel into evidentiary objections, jury instructions, opening statements, closing arguments, and even witness examinations can better advance the client’s position both at trial and in the event of an appeal.
