Leveraging Unique Procedures in International Arbitration to Protect Against a Breaching Counterparty


In the first session of the Knowledge & Social series, speakers Anisha Sud and Joel Ng will share strategies and provide practical advice on how international arbitration, as a dispute resolution mechanism, can be a powerful tool for companies involved in international disputes to retain control in situations where a counterparty breaches, or threatens to breaches, its contractual obligations. 

Our speakers will focus on five often-overlooked procedures and safeguards that international arbitration uniquely offers, including (1) emergency arbitration, (2) interim measures, (3) interrogatories, (4) early (pre-pleading discovery), and (5) security for costs and claims, all of which can be leveraged in a dispute to ensure that a breaching counterparty continues to perform its obligations pending the resolution of the dispute, or to otherwise best-position the company for success.  The speakers will also describe some of the reasons why international arbitration is increasingly chosen as a dispute resolution mechanism by parties, including the ease of enforceability of arbitral awards, confidentiality of proceedings, ability to select tribunal members, and ability to bifurcate issues.
