K&S Appellate Team Obtains Reversal of $70 Million in Three Judgments Against RJR on Appeal

In three separate Engle progeny cases tried to verdict in Broward County, Florida, King & Spalding obtained reversals of judgments in favor of plaintiffs totaling $70 million in compensatory and punitive damages.  In the three cases, Pollari v. R.J. Reynolds Tobacco Company, McCoy v. R.J. Reynolds Tobacco Company and Ryan v. R.J. Reynolds Tobacco Company, the K&S appellate attorneys successfully briefed and argued before Florida’s Fourth District Court of Appeal that plaintiffs had improperly relied on federal government reports, which were inadmissible hearsay, to improperly bolster the testimony of their expert witnesses.  The Fourth District Court of Appeal agreed and reversed each of the three judgments.  The decisions in these cases are precedent-setting in changing a significant dimension of how these cases are tried to juries.
