Global Warming Litigation Goes Cold

King & Spalding represented Chevron in Comer v. Murphy Oil USA, Inc., et al, and secured dismissal in federal district court and the Fifth Circuit of this litigation -- one of the first climate change tort complaints (2009) -- which was filed on behalf of a purported class of Mississippi residents and landowners who claimed that their Hurricane Katrina-related damages resulted from intensification of the storm due to effects of global warming and that the greenhouse gas emissions of energy industries contributed to that global warming.

Comer v. Murphy Oil USA, et al, 585 F.3d 855 (5th Cir. 2009) (Comer I); 718 F.3d 460 (5th Cir. 2013) (Comer II)
