King & Spalding e-Learn: Ethics – IP Practice Developments in 2016


The presentation will focus on ethical issues faced by practitioners handling matters with a significant intellectual property component (patent, trademark, copyright). Specifically, the presentation will address ethical issues that arise in IP prosecution and litigation contexts - including conflicts, client identity, duty of competence, the unauthorized practice of law, confidentiality, responsibilities in making statements to the USPTO, investigations, use of social media and more. The presentation will review the various rules that apply to practitioners, including state and USPTO rules, as well as recent decisions from the USPTO's Office of Enrollment and Discipline.
