Feb. 4, 2021, LOS ANGELES – The Daily Journal has recognized a King & Spalding litigation victory for Postmates Inc. among the Top Verdicts of 2020 in California.
In the widely-reported case with important implications for vicarious liability under the federal Telephone Consumer Protection Act, the firm won a complete dismissal with prejudice of a nationwide “robotexting” class action against Postmates by convincing a Northern District of California judge that the plaintiff failed to establish that Postmates had controlled the manner and means of the marketers who had sent the texts.
The Los Angeles-based team representing Postmates included partners Albert Giang and Arwen Johnson and associate Samuel Cortina.
