Compliance Issues Related to Receipt of CARES Act Funding, plus Latest Congressional and CMS Actions Related to COVID-19

Please join King & Spalding on April 24, 2020 for a discussion of the terms and conditions attached to CARES Act funding, and related compliance and liability considerations, plus a report on the latest Congressional and CMS actions related to COVID-19 and its impact on the healthcare provider community.  

Our panel will cover these topics:

  • Compliance with conditions of receipt of CARES Act funding, including:
    • Who is an eligible healthcare provider;
    • What we know about the meaning of the terms and conditions and attestation;
    • Understanding the permitted and non-permitted uses of the funds;
    • What we know about the quarterly reporting requirements.
  • Update on funding based on anticipated release of the $70 billion Congress allocated for hospitals and health-care providers in the COVID 3 relief package; and
  • The Trump Administration and bipartisan congressional leaders are reportedly close to a deal, known informally as COVID 3.5, to provide supplemental funding for COVID-19 response activities.  It will likely include a $300 billion increase in the Paycheck Protection Program plus additional funding for hospitals (potentially $75 billion) and for diagnostic tests (potentially $25 billion).  King & Spalding will continue tracking COVID 3.5 and will provide an update on Friday.
