Clarion Partners Prevails on Motion for Summary Judgment

King & Spalding prevailed on a motion for summary judgment on behalf of Clarion Partners in a case raising complex questions about the extraterritorial reach of the RICO statute and international comity, and implicating high level government officials including the former Mexican Attorney General and the Attaché of Homeland Security Investigations to Mexico.

King & Spalding represented Clarion Partners, a fund of Clarion called Lion Mexico, and current and former individual Clarion officers Onay Payne, Ron Brown and Jim Hendricks in this civil RICO matter before Judge Ezra in the Western District of Texas, San Antonio Division.  The plaintiffs, three Mexican citizens and three Mexican companies they own and control, alleged that defendants gained and maintained control of a real estate investment project in Mexico by misrepresenting the nature of their investment in the project, wrongfully foreclosing on the property, and bribing Mexican officials (including Mexico’s former Attorney General) who induced others in Mexico and the United States to prosecute and harass plaintiffs and their families.
