Contracts between healthcare providers and commercial payors are increasingly being terminated, either by providers who believe the rates are too low or terms are too onerous, or by payors who believe they can unilaterally determine lower payment rates to out-of-network providers. Hospital charges are also being challenged by class action attorneys representing uninsured patients, claiming that hospital charges cannot be reasonable and customary, and that billing charges to uninsured patients constitutes an unfair business practice.
