Bass Pro, LLC has secured a settlement involving $40+ million in payments to Bass Pro plus tens of millions in additional future revenue in a negotiated agreement ending its contractual dispute with Bluegreen Vacations Unlimited, a seller of timeshare interests.
Austin-based partners Mike Stenglein and Adam Gray investigated the matter and advised Bass Pro in negotiations with Bluegreen for over a year prior to filing a lawsuit against Bluegreen in Federal District Court for the Western District of Missouri on April 17, 2019. Bass Pro alleged a pattern of contractual breaches by Bluegreen, including Bluegreen’s failure to pay required commissions and Bluegreen’s engagement in prohibited high-pressure salesmanship. After Bass Pro cancelled Bluegreen’s access to the Bass Pro Shops, Bluegreen filed a counterclaim seeking either injunctive relief or lost future profits in excess of $300 million.
On June 13, 2019, Bluegreen publicly announced that the parties had reached a settlement agreement to resolve the lawsuit. The parties also agreed to dismiss the pending litigation.
