On Tuesday, January 26, 2021, at noon Eastern, King & Spalding will be hosting a follow-up roundtable webinar to our November 2020 Webinar on “Challenging Payers’ New Specialty Pharmacy Policies that Reduce Payment to Hospitals.” King & Spalding is representing a number of hospitals in responding to the health plans’ specialty pharmacy policies, also known as white-bagging policies. In general, these policies prohibit hospitals from directly sourcing and supplying specialty drugs under their agreements with payers, and hospitals cannot receive payment unless they purchase from the payer’s preferred pharmacy. The policies raise a number of issues, including breach of contract, administrative burden, and quality of care.
During our January 26 webinar, we will highlight new developments with respect to payers’ implementation of white-bagging policies. We will delve into what is at stake for hospitals from the perspectives of financial impact and patient safety. We will also discuss the different ways in which the industry has been responding to and challenging these policies.
In addition, during the webinar, we will go over the results of a targeted survey that we sent to a number of hospitals. The survey seeks hospitals’ input on the rollout of white-bagging policies, how these policies are affecting them, how hospitals have been responding to these policies, and payers’ reactions to these responses. We will aggregate the responses and discuss the group’s common experiences at the January 26 webinar.
