On Friday, September 28, 2012, at 1:00 - 2:30 P.M. Eastern Time, King & Spalding will host an Atlanta-based Roundtable focused on recent developments in healthcare executive liability. We are also offering a Webinar option for the Roundtable. The Roundtable is prompted by the government’s recent emphasis on pursuing “responsible” health care executives personally for fraud, waste, and abuse. The government has long been concerned that health care executives view civil and criminal fines imposed against their companies as merely a “cost of doing business.” In response, regulators have promised to take action to “alter the cost benefit calculus of the corporate executives who run these companies” by individually pursuing those that are responsible for the fraud. In apparent fulfillment of this promise, there have been a number of recent prosecutions of health care executives, and federal courts have endorsed OIG’s broad authority to exclude “responsible corporate officers” under its permissive exclusion authority. This Roundtable will focus not only on these developments in health care executive liability, but also provide valuable insight on measures that may be taken to avoid such liability.

- Director and officer liability insurance policies, undertakings, "Upjohn warnings," and defense issues for consideration by individuals
- OIG’s increasing use of exclusion authority to target healthcare executives
- Discussion of factors reviewed by OIG in exclusion decisions
- Criminal liability for executives under the responsible corporate officer doctrine
- Lessons learned from recent high-profile prosecutions and exclusion proceedings against healthcare executives
