  • Represented healthcare providers, manufacturers, and other entities in the defense and multi-million dollar settlements of False Claims Act investigations and related qui tam actions regarding allegedly improper billings to federal healthcare programs, off-label issues, quality of care issues, medical necessity issues, Medicaid supplemental payment issues, and alleged violations of the Stark Law.

  • Represented a large multi-hospital organization headquartered in Nashville in connection with the acquisition and sale of hospitals and joint ventures of ambulatory surgery centers and diagnostic imaging centers throughout the country.

  • Represented approximately 700 hospitals in administrative appeals and federal court litigation challenging annual wage index miscalculations affecting the standard payment rate applied to determine present, future and past Medicare payments for inpatient hospital services, and won a global settlement for these clients for approximately $1.7 billion.

  • Advised a hospital group purchasing organization and its 2,300 hospital members regarding electronic health records incentives and penalties under the HITECH Act passed as part of the American Recovery and Reinvestment Act of 2009.

  • Represented one of the nation’s leading cancer research and treatment centers in the negotiation of a technical assistance and consulting agreement for the creation of a radiation oncology treatment center in Istanbul, Turkey.

  • Represented one of the country’s largest academic medical centers in a False Claims Act investigation of its Medicare outlier payments, successfully convincing the government to drop its investigation of our client.

  • Represented a multi-hospital system in one of the first matters considered by CMS under the Stark law self-disclosure protocol that CMS issued in September 2010.

  • Represents multiple national and regional healthcare systems as well as numerous individual hospitals in connection with government contractor audits and disputes, including Medicare Recovery Audit Contractors, Medicaid RACs, Medicaid Integrity Contractors, Program Safeguard Contractors, and Zone Program Integrity Contractors.

  • Represented an academic medical center in an administrative appeal of the denial of all Medicare funding for a new graduate medical education program, recovering approximately $16 million for the hospital for all the academic years at issue.

  • Acted as national coordinating counsel for pharmaceutical manufacturer in a series of cases brought by state Attorneys General alleging fraud, violation of consumer protection laws and state Medicaid laws, and unjust enrichment in the reporting of certain prices for prescription drugs.

  • Represented a healthcare financial services company in seven deals for an amount exceeding $1 billion, including multiple deals in excess of $200 million.

  • Represents a coalition of some of the nation’s largest DME supply companies of disposable products before numerous states to challenge state laws seeking to restrict Medicaid beneficiaries’ choice of eligible suppliers to a single source.

  • Advised a national retail pharmacy chain and pharmacy benefit manager on healthcare and insurance regulatory matters with respect to its approximately $1.4 billion acquisition of a Medicare Part D prescription drug plan business.

  • Represented an academic medical center in resolving a major investigation of its Institutional Review Board by the U.S. Office for Human Research Protection.

  • Represented a home health care provider in a lawsuit seeking injunctive relief based on the misappropriation of trade secrets and other confidential data by former marketing employees and secured an injunction prohibiting the employees from having any contact with clients or referral sources with whom the employee had contact while employed by our client.

  • Represented a Texas critical access hospital in a successful challenge to CMS policy regarding the cost-based reimbursement of certified registered nurse anesthetists, ultimately reversing the policy for all similarly situated critical access hospitals.

  • Represented seven nonprofit health systems or underwriters of nonprofit health systems in connection with the issuance of approximately $912 million of debt in 2011.

  • Represented various national retail pharmacy clients in federal and state enforcement matters involving pharmaceutical distribution, dispensing, and diversion.

  • Represented a global leader in providing automated instrument-reagent systems to the blood transfusion industry as it was acquired through a short form merger following a tender offer.

  • Represented a Fortune 500 company in Delaware Chancery Court litigation against an Indian multinational software development firm arising out of the design of a state-of-the-art Medicaid claims processing system.

  • Represented a hospital district located in the coastal bend geographic region in Texas in the development and implementation of a recently approved Medicaid supplemental payment/1115 Waiver program to provide enhanced Medicaid payments to hospitals and other providers.

  • Represented a pharmaceutical manufacturer in litigation involving a leading antidepressant and related proceedings, including multi-district proceedings in California and individual suits throughout the country.

  • Represented a public health system and teaching hospital in the Southwest in restructuring its system-wide professional services arrangements in a multi-specialty physician practice and faculty group.

  • Represented healthcare providers in negotiations related to key managed care relationships and in payor disputes arising out of improper reimbursement and network participation issues.

  • Advised a leading Abu Dhabi-based healthcare development and investment company on its agreement with TERNA, S.A., for the construction of the Danat Al Emarat Women & Children’s Hospital in Abu Dhabi.

  • Performed regulatory due diligence and analysis of proposed transactions under healthcare fraud and abuse laws in connection with healthcare acquisition transactions.

  • Represents several pharmaceutical and medical device companies with potential and active congressional investigations in both the House and Senate, providing strategic counsel in connection with such inquiries and managing interactions with investigators.

  • Represented multiple healthcare organizations in negotiating and complying with Corporate Integrity Agreements with HHS OIG.

  • Represented a nonprofit health system including six hospitals and related healthcare facilities in the sale of its assets to a national investor-owned hospital management company based in Nashville.

  • Assisted a hospital system with the patent application for a system of coronary artery disease risk assessments.

  • Represented a pharmaceutical manufacturer in connection with an investigation by the Department of Justice of the company’s alleged off-label sales and marketing of an FDA-approved prescription drug.

  • Advised a multi-hospital system in its acquisition of a non-profit hospital system, requiring notification to the Federal Trade Commission and approval from the State Attorney General’s Office.

  • Represented an Oklahoma hospital in federal court and obtaining a favorable settlement in a Medicare regulatory dispute involving transition period payments to new hospitals for capital costs.

  • Represented a dental management company in connection with exclusion proceedings and investigations by the DOJ, the OIG, and a number of states.
