As a result of the depth of our experience, we are frequently asked to prepare amicus briefs on important First Amendment issues before the Supreme Court of the United States and state and federal appellate courts.
Our practice includes both litigation and counseling on a wide variety of entities and individuals on media law and First Amendment issues, including defamation, privacy, newsgathering, Freedom of Information Act, challenges to governmental and private regulations of speech, commercial speech, advertising, copyright, and Internet and e-commerce. We also regularly advise our business clients on commercial disputes and trade libel / advertising claims raising these kinds of issues.
While our practice focuses on representation of defendants, when circumstances warrant we also advise and represent potential libel/privacy plaintiffs. We assess the validity and practical impact of the allegations and determine how best to proceed to mitigate the consequences by helping our clients ascertain whether a cause of action exists and if so, what the consequences will be of bringing suit.
