The security of computerized data and the ability to respond to unauthorized penetration of computer networks presents great business and legal risks to public and private entities.  In recent years, incidents involving unauthorized access to corporate data and cybersecurity have become ubiquitous across industries.  Not a week goes by without headlines warning of cyber threats to intellectual property or the risk of disruptions to industry from the loss or destruction of data.  National and international corporations are confronted by  cyber threats involving  the theft of intellectual property and spin-off investigations and litigation.  In short, any cyber incident or data breach raises significant crisis management challenges for targeted entities.  Moreover, the national and international regulatory landscape is in a state of significant flux.  While policymakers and regulatory authorities are keen to address cybersecurity risks, some are not always as concerned with  balancing the privacy interests of individuals and the private sector.  In sum, proposed cybersecurity standards may place historic and heightened burdens on the private sector.
