Roundtable: Revisions to the HIPAA Privacy, Security and Enforcement Rules

On Wednesday, August 11, 2010, we will be hosting a new Roundtable focused on the proposed changes in the HIPAA Privacy, Security and Enforcement Rules, published on July 14, 2010, implementing changes mandated by the HITECH Act.  These new proposed rules would substantially expand the responsibilities of business associates and impact the way in which the Secretary of HHS imposes civil monetary penalties for violations of the privacy and security standards and the breach notification requirements.  (This Roundtable previously was paired with, and set to precede, another Roundtable covering the final Meaningful Use Rule.  The Meaningful Use Roundtable now has been re-scheduled to Thursday, August 19, 2010.  You are still invited to register for both Roundtables if you wish.)

We will again offer a Webcast option for this Roundtable. You can register to attend in person or by Webcast by clicking the Register button at the bottom of this page. For full participation, including an ability to hear any attendee discussion well, we recommend in-person attendance.  Lunch will be provided between 12:00 p.m. and 1:00 p.m. if you would like to arrive early for that.  We hope you will be able to join us.

Agenda

The Roundtable will cover the following topics:

  • The proposed changes to make civil monetary penalties and other enforcement provisions directly applicable to business associates
  • Clarification and revisions to the factors to be considered by the Secretary in determining a civil monetary penalty
  • Changes to the circumstances under which a covered entity is liable for the acts of a business associate
  • Liability of downstream entities working on behalf of a business associate
  • Amendment of the definition of "reasonable cause" for purposes of enforcement actions

We will facilitate the discussion, but we hope that everyone present will contribute to the interchange of ideas. In-person attendance is limited, so please register soon to reserve seats for your organization. You do not have to be a client to attend, and there is no charge.
