Patrick Morrisey, a partner with a broad-based health care practice focused on regulatory, policy, investigations, reimbursement, price-reporting, legislative, and strategic counseling matters, is co-chair of the firm’s FDA and Life Science Practice and a member of the Health Care and Public Policy groups.   He is widely recognized for his knowledge and experience on Medicare, Medicaid, and FDA policy, regulatory, and legislative issues, particularly those involving pharmaceutical companies, device manufacturers, plans, and providers.  Mr. Morrisey is deeply involved in health care reform issues and provides extensive services to clients seeking to mitigate risk and understand the financial, regulatory, and commercial implications of the emerging health care environment. 

Before joining King & Spalding, Mr. Morrisey practiced at another large firm for over six years, where he represented successfully numerous clients on precedent setting matters -- before the Department of Health and Human Services (HHS), the Centers for Medicare and Medicaid Services (CMS) and Congress -- pertaining to the coding, coverage, and payment of items and services under the Medicare Program. A large portion of his practice focuses on providing companies with regulatory and legislative analysis, pre-litigation and investigation assessments, and strategic counseling on: health care reform, reimbursement, Medicare Part D, the Average Sales Price law, Medicare Part B, Medicaid, the government’s authority to institute price controls, manufacturer-distributor relationships, provider reimbursement and compliance matters, the inter-relationship between FDA policies and Medicare reimbursement, pharmaceutical price reporting laws, and the development of creative and sustainable business models that maximize company’s revenue, enhance program integrity, and mitigate fraud and abuse risk. He is regularly quoted for his observations on healthcare reform, Medicare, Medicaid and the policies related to the financing of federal healthcare programs, and is relied upon by companies for due diligence of entities within the healthcare industry. Mr. Morrisey also handles congressional oversight investigations for clients and manages investigations before the HHS Office of Inspector General and other agencies, involving pharmaceutical and device pricing issues and  fraud and abuse matters.

Until March of 2004, Mr. Morrisey served as the Deputy Staff Director and Chief Health Counsel for the House Energy and Commerce Committee – a committee charged with jurisdiction over Medicare, Medicaid, the FDA, healthcare insurance, and public health matters. In that capacity, Mr. Morrisey served as a principal staff author and key negotiator of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003. He also helped author bioterrorism and public health legislation and some of the most far reaching changes to the Federal Food, Drug and Cosmetic Act since its inception.

During his tenure with the Committee, Mr. Morrisey regularly advised the Chairman and many Members of Congress on policy matters and served as the Committee's lead healthcare negotiator on matters involving the White House, HHS, CMS, FDA, the Ways and Means Committee and the Senate. He has spoken extensively at national healthcare forums on the Medicare prescription drug benefit, healthcare reform, Medicare and Medicaid reforms, AWP, ASP, AMP, device reimbursement, fraud and abuse compliance, modifications to the Hatch-Waxman law and other topics.

Before joining the Energy and Commerce Committee in 1999, Mr. Morrisey practiced law and represented numerous healthcare providers, including managed care organizations, hospitals, ambulatory surgery centers, physicians, clinical diagnostic laboratories, home health agencies and nurse practitioners. He has also published articles on a wide range of Medicare regulations and counseled several Members of Congress on election law matters.

Mr. Morrisey has extensive political experience and has worked for a number of senior public officials, including Congressman Bill Paxon (R-NY), Chairman Tom Bliley (R-VA), Chairman Billy Tauzin (R-LA) and Christine Todd Whitman (R-NJ).  He is currently active in a number of charitable and political activities.  Mr. Morrisey graduated with honors from Rutgers College and earned his juris doctor from Rutgers Law School.
