Kelsey Desloover has an environmental, health, and safety (EHS) practice with a focus on hazardous waste management.  She advises clients on EHS compliance with federal and state laws and EPA, OSHA, and state regulations.  Kelsey also advises clients in internal investigations, litigation, and regulatory proceedings involving EHS issues.  She specializes in compliance with federal and state laws and regulations governing the storage, handling, and disposal of hazardous waste.  She advises clients on waste management issues pertaining to pharmaceuticals, medical devices, tobacco products, and toxic chemicals.  Kelsey also works with clients to develop robust, sustainable EHS management systems, maintain those systems through compliance audits, and revise them to comply with new regulatory developments.   In doing so, she works with a variety of scientific and technical experts to assess and mitigate regulatory compliance risks.  She is with the firm’s Tort and Environmental practice group in Washington, D.C.

Kelsey’s representative experience includes:

  • Preparing public comment to EPA on behalf of a manufacturing client concerning the retail industry’s compliance burden under RCRA’s hazardous waste management requirements.

  • Advising a manufacturing client on proper handling and disposal of its newest pharmaceutical and tobacco products under RCRA.

  • Conducting environmental due diligence for purchasers and lenders in complex transactions involving multiple properties.

  • Preparing public comment on behalf of a medical device manufacturer on a proposed EPA rule to change the listings of certain propellants used in medical aerosols in its Significant New Alternatives Policy (SNAP) program under the Clean Air Act.

  • Advising a wind turbine manufacturer on OSHA compliance issues, for purposes of contract negotiations.

  • Conducting legal review of EHS compliance audits for an industrial equipment manufacturer.

  • Assisting in developing corporate EHS compliance programs, including EHS management systems and other corporate-level policies for manufacturing and retail clients.

  • Evaluating EHS management systems consistent with ISO 14001, OHSAS 18001, and other leading industry standards.

  • Advising manufacturing client on new DOT requirements for transporting lithium batteries across the supply chain.

  • Representing a chemical manufacturing company in negotiations with an insurance company for a Superfund (CERCLA) site.

  • Reconstructing the regulatory and scientific history of a known health hazards and toxic chemicals, for purposes of litigation and waste management advice.
