Representative Experience
- Represented State academic medical center in self-disclosure of overcharging of indirect cost (F&A) rate for NIH research grants;
- Represented various participants regarding the development and implementation of Medicaid supplemental payment/UPL programs to provide enhanced Medicaid payments to hospitals and other providers located in Bexar, Crockett, Dallas, Harris, Hutchinson, Tarrant, and Tom Green counties in Texas;
- Represented a hospital district in settlement of a federal and state False Claims Act “whistleblower” action where suit was originally filed pursuant to the qui tam provisions of the FCA and Texas Medicaid Fraud Prevention Act;
- Represented various state university medical schools in obtaining favorable Office of Inspector General advisory opinions addressing financial arrangements and donation of medical office building;
- Represented healthcare industry clients in obtaining Medicare coverage for new products and services including obtaining Medicare DRG for drug eluting stents; and
- Represented local governmental hospital district in transfer of hospital assets and operations to private healthcare system and negotiation of Indigent Care Agreement between hospital district and healthcare system.
