Dan Hettich is an associate in King & Spalding’s Washington D.C.’s Healthcare Practice Group and a member of the King & Spalding Healthcare Reform Task Force. Mr. Hettich advises health care providers on a full range of legal issues surrounding Medicare reimbursement and advocates on their behalf before various administrative and judicial bodies. In this capacity, Mr. Hettich has assisted in the prosecution of dozens of appeals before the Provider Reimbursement Review Board and is facile in both the procedural rules, and substantive Medicare reimbursement law, underlying these disputes. Mr. Hettich has also successfully litigated issues before ALJs, where he recently completed a successful pro bono representation of a child with sickle-cell disease seeking SSI benefits, and the Departmental Appeals Board, where he recently received a decision for a hospital client overturning CMS’s denial of critical access hospital status.
While Mr. Hettich’s experience begins at the agency level, it extends all the way to the D.C. Circuit Court of Appeals where he recently helped achieve a favorable decision on an inpatient Medicare reimbursement issue and was “second chair” at oral argument.
Mr. Hettich regularly advises clients on various aspects of Medicare reimbursement and related issues. Representative experience includes drafting comment letters on behalf of industry stakeholders, advising on successor liability issues associated with changes of ownership, advising in aspects of False Claim Act liability, and analyzing hospital billing and collection polices for compliance with Medicare’s bad debt billing requirements.
Mr. Hettich has spoken on Medicare reimbursement issues in various national venues, including the ABA’s Health Summit, the AHLA's Hospital and Health Systems Law Institute and Medicare and Medicaid Institute (upcoming), and BKD’s Hospital Regulatory and Reimbursement Conference.
